SkyTile Terms of Service

Welcome to SkyTile. These Terms of Service (“Terms”) govern your use of the SkyTile mobile application, connected SkyTile displays and their software, website, online store, and related features and services (collectively, the “Services”).

“We,” “us,” and “our” refer to SkyTile. “You” refers to the person accessing or using the Services or purchasing our products.

By accepting these Terms, creating an account, or purchasing or using the Services after being provided notice of these Terms, you agree to be bound by them. If you do not agree, do not create an account or use the Services.

Our Privacy Policy explains how we handle personal information. Acceptance of these Terms does not replace any separate consent required by applicable privacy law.

1. Eligibility and Accounts

You must have reached the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.

You must provide accurate, current information when creating an account or placing an order and update that information when necessary. You may create an account using the sign-in methods we make available, including email, Apple, or Google.

You are responsible for keeping your account credentials confidential and for activity you authorize through your account. Notify us promptly if you suspect unauthorized access. Nothing in these Terms makes you responsible for unauthorized activity to the extent applicable law provides otherwise.

You may not sell, transfer, or share your account credentials with another person. Transferring ownership of a physical SkyTile display does not transfer your account.

2. What SkyTile Provides

SkyTile is a connected aircraft-information display and companion mobile app. Depending on the available features, the Services allow you to configure a display, establish an aircraft detection area, view flight information, manage device settings, and see aircraft sighting statistics.

The aircraft shown on your display are selected using available flight data and your saved detection settings. References to “detection,” “sightings,” or “live” information do not mean that your SkyTile independently detects every nearby aircraft or receives instantaneous, complete information.

Features and availability may vary by location, hardware, operating system, app version, connectivity, and third-party data coverage.

3. Flight Information and Safety

SkyTile is intended for general information and personal enjoyment. It is not an aviation navigation, air traffic control, collision avoidance, emergency, or safety system.

Do not use SkyTile to operate or navigate an aircraft, vehicle, or drone; determine whether airspace is clear; assess flight safety; or make other decisions where inaccurate or unavailable information could result in injury, death, or property damage.

Flight information may be delayed, incomplete, unavailable, estimated, or inaccurate. Aircraft positions, identities, routes, destinations, departure and arrival times, and other details may change or differ from actual conditions. Some aircraft may not appear at all.

Sighting counts and other statistics reflect information processed by the Services and are not certified records of aircraft activity. The absence of an aircraft from the Services does not mean that no aircraft is present.

Use official sources and appropriate certified equipment for operational or safety decisions. Do not interact with the app or display when doing so would distract you from safely operating a vehicle or equipment.

4. Device Setup and Connectivity

To use connected features, you need a compatible SkyTile display, a supported mobile device and operating system, a SkyTile account, and suitable internet access. Setup and certain controls also require Bluetooth and the permissions requested by the app.

The app uses your phone’s location to establish or refresh the aircraft detection area. That saved area does not automatically follow your phone as you move. If you relocate your SkyTile, review and update its detection settings.

Only connect a SkyTile display to an account or Wi-Fi network that you own or are authorized to use. You are responsible for your internet access, mobile data charges, network configuration, and compatible equipment.

Connectivity interruptions, power loss, disabled permissions, incorrect settings, or third-party outages may prevent setup, updates, flight information, or device controls from working. Turning the display off does not necessarily disconnect the device from the internet or delete its information.

Follow the setup, power, placement, and safety instructions supplied with your product.

5. Software License and Ownership

Subject to these Terms, SkyTile grants you a limited, nonexclusive license to install and use the app on compatible devices you own or control, and to use SkyTile device software with a SkyTile display you lawfully possess, for personal, noncommercial purposes.

The app and device software are licensed, not sold. Purchasing a physical display does not transfer ownership of the software, flight datasets, trademarks, or other intellectual property used by the Services.

Except as permitted by applicable law, an applicable open-source license, or our written authorization, you may not:

  • Copy, redistribute, sell, sublicense, or commercially exploit the app, device software, or data feeds.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Remove intellectual property notices.
  • Circumvent authentication, security measures, or access restrictions.
  • Present SkyTile data or services as your own product or service.

These restrictions do not limit rights you have under applicable repair, interoperability, accessibility, or other mandatory laws.

Third-party and open-source components remain subject to their respective licenses. Those licenses control where they grant rights that differ from these Terms.

6. App Stores and Third-Party Services

Downloading or using the app through Apple’s App Store or Google Play is also subject to applicable store terms and usage rules.

For an app obtained through Apple’s App Store, the software license is governed by the end-user license agreement provided with the app, including Apple’s Standard End User License Agreement where no custom agreement is supplied. These Terms supplement that agreement and do not override applicable App Store usage rules.

The Services depend on third-party infrastructure, authentication, maps, and flight data. Those providers may change their offerings, experience outages, or limit coverage, which can affect SkyTile.

Links to independent websites or services do not constitute an endorsement. Your use of those services is subject to their applicable terms and privacy policies. This section does not limit obligations SkyTile has to you under applicable law.

7. Updates and Service Changes

We may provide updates to the app, device software, or cloud services to address security, compatibility, reliability, or functionality. You may need to install an updated app version to continue using the Services.

Features may change over time. We may modify or discontinue features or support for particular versions where reasonably necessary, including because of security issues, technical limitations, legal requirements, or changes to third-party services.

Where a change or discontinuation materially affects a product or service you purchased, we will provide reasonable notice when practicable and any remedies required by applicable law. These Terms do not override an express support commitment, product promise, or legally required update obligation.

Connected features depend on the continued availability of the supporting cloud services. Their interruption or discontinuation may affect the functionality of your display.

8. Products, Orders, and Payments

Product descriptions, compatibility information, prices, and availability are shown in our store. Product images are illustrative, and colors or appearance may vary between screens. This does not limit your right to receive a product that conforms to its description and applicable legal requirements.

Placing an order is an offer to purchase. We may decline or cancel an order for reasonable grounds, including unavailable inventory, suspected fraud, payment problems, or a material pricing error. An order is accepted when we expressly confirm acceptance or dispatch the product. An automated acknowledgment alone does not necessarily constitute acceptance.

If we cancel an order after collecting payment, we will refund the canceled portion. We will not charge a higher price to correct an error without your agreement.

You must provide accurate billing, shipping, and payment information and be authorized to use the selected payment method.

Applicable prices, taxes, and shipping charges are shown before you place your order. For international orders, additional customs duties or import charges may apply as disclosed at checkout or required by local law.

Price changes do not affect an order we have already accepted. Separate promotional terms apply where clearly disclosed and control any conflict relating specifically to that promotion.

Any separately offered paid digital feature or recurring plan will require disclosure of its price and applicable payment terms before you agree to purchase it. These Terms alone do not authorize a recurring charge.

9. Shipping, Returns, and Warranties

Shipping and delivery estimates are provided with your order. If we cannot ship within the applicable promised or legally required period, we will provide the notice, cancellation options, and refunds required by law.

Contact us if an order is lost, damaged, or does not arrive. Responsibility for delivery and risk of loss will be determined by applicable law and any valid delivery terms disclosed when you purchase.

Returns, exchanges, and voluntary refunds are governed by the Refund Policy displayed in our store at the time of purchase. That policy does not restrict statutory cancellation rights or remedies for defective, damaged, misdescribed, or undelivered goods.

Any written product warranty supplied with your purchase applies according to its terms, in addition to rights that cannot legally be excluded.

Deleting your app account or uninstalling the app does not by itself cancel an order or initiate a return or refund.

10. Relationship with Shopify

Our online store is powered by Shopify. Purchases from that store are transactions between you and SkyTile, not between you and Shopify.

Shopify is not responsible for fulfilling our orders, supporting our products, or our obligations as the seller. To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising from purchases and transactions with SkyTile. This does not exclude liability that cannot lawfully be excluded.

Shopify’s role as our commerce platform does not mean it hosts or operates the SkyTile mobile app or connected-device infrastructure.

Shopify processes information about store visits and purchases. Where its enhanced services are enabled, this may include processing information together with information from interactions with other merchants and Shopify. Information may be shared with Shopify and other providers in other countries. See our Privacy Policy and the Shopify Consumer Privacy Policy.

11. Acceptable Use

You must use the Services lawfully and respect the rights of others. You may not:

  • Access another person’s account, display, network, or information without authorization.
  • Use flight information to stalk, threaten, harass, or facilitate harm.
  • Interfere with the Services, overload infrastructure, or distribute malware.
  • Bypass security controls, rate limits, or account restrictions.
  • Impersonate another person, submit fraudulent orders, or provide deceptive information.
  • Extract or redistribute flight data or other content in bulk without permission.
  • Use bots, scripts, or other automated tools to abuse the Services, evade restrictions, or access nonpublic systems.
  • Infringe intellectual property, privacy, or other legal rights.

Ordinary authorized use of accessibility tools, password managers, and personal shopping assistance is not prohibited merely because it involves automation, provided it does not bypass security controls or otherwise violate these Terms.

You must comply with applicable export controls, sanctions, and other legal restrictions when obtaining, transferring, or using the Services.

12. Content, Reviews, and Feedback

SkyTile’s branding, app and website designs, text, graphics, and other content belong to SkyTile or its licensors. Except for the use permitted by these Terms or applicable law, you may not reproduce or commercially exploit them without permission.

You retain ownership of reviews, suggestions, and other content you submit.

If you submit content for public display, such as a product review, you grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and distribute it in connection with operating and promoting the Services. We will not materially alter a review to misrepresent your opinion.

You must have the necessary rights to submitted content and disclose relevant incentives or compensation. Content must not be unlawful, misleading, abusive, or infringe another person’s rights.

We may use voluntary product ideas and suggestions to improve the Services without compensation unless we separately agree otherwise.

This section does not authorize us to publish private support communications or personal information contrary to our Privacy Policy. We may remove public content that violates these Terms, but we will not prohibit or penalize honest reviews protected by law.

13. Account Deletion and Device Transfers

You may stop using the Services at any time. You can request account deletion through Settings → Delete account in the app or by contacting contact@theskytile.com.

Account deletion removes your account and its device associations. Where no other account remains associated with a display, its cloud configuration and associated sighting records are also removed. This may prevent connected features from operating until the device is set up again.

Deletion and any necessary retention of personal information are handled as described in our Privacy Policy.

Deleting your account does not automatically erase information stored on the physical display, including Wi-Fi credentials. Before selling, gifting, returning, or disposing of a display, contact us for assistance removing your information and preparing it for transfer.

These Terms do not prohibit lawful resale or gifting of your physical display. Your account and credentials must not be transferred with it.

14. Suspension and Termination

We may restrict, suspend, or terminate access where reasonably necessary because of a material breach of these Terms, fraud, a security threat, unlawful activity, or a legal requirement.

Where practicable and appropriate, we will explain the reason and provide an opportunity to resolve the issue. We may act immediately where necessary to protect users, the Services, or legal compliance.

Suspension or termination may affect the connected features of your display. It does not remove consumer rights, outstanding refund obligations, or other obligations that already arose.

You may contact us if you believe an account restriction was applied in error.

Provisions that by their nature should continue after termination—including intellectual property rights, payment obligations already incurred, applicable liability provisions, and dispute terms—will continue to apply.

15. Disclaimers and Consumer Rights

We aim to provide useful and reliable Services, but cannot guarantee uninterrupted access, error-free software, or complete and accurate flight information.

To the extent permitted by applicable law, and except for express commitments and warranties we provide, the app, cloud features, and informational content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement only to the extent those warranties may lawfully be disclaimed.

Nothing in these Terms excludes or limits mandatory consumer rights, applicable written warranties, or remedies for products or services that fail to meet legally required standards.

If applicable law does not allow a disclaimer or limitation, that provision does not apply to you to the extent prohibited.

16. Limitation of Liability

To the extent permitted by applicable law, SkyTile and its personnel, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of or inability to use the Services. This includes lost profits, business interruption, and loss of data to the extent those losses fall within the excluded categories.

These limitations apply regardless of the legal basis of the claim, but only to the extent enforceable under applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

These Terms do not eliminate your right to refunds, repairs, replacements, compensation, or other remedies required by applicable law.

17. Responsibility for Third-Party Claims

To the extent permitted by applicable law, you agree to reimburse SkyTile for reasonable losses and legal costs resulting from third-party claims caused by your intentional misuse of the Services, unlawful conduct, infringement of another person’s rights, or material breach of these Terms.

This obligation does not apply to the extent a claim results from SkyTile’s negligence, misconduct, breach of these Terms, or other responsibility under applicable law.

We will notify you of a relevant claim and take reasonable steps to limit losses. We will not agree to a settlement that requires an admission or additional obligation from you without your consent.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington and applicable United States federal law, except where mandatory law requires otherwise.

Please contact us first if you have a concern so we can try to resolve it. Doing so is not a condition of exercising your legal rights.

Unless applicable law provides otherwise, disputes concerning these Terms may be brought in the state or federal courts in Washington, and you and SkyTile consent to jurisdiction there.

If you are a consumer entitled to mandatory protections under the laws of your place of residence, these Terms do not deprive you of those protections or any right to bring proceedings in your local courts.

These Terms do not require arbitration or waive participation in a class action.

19. General Terms

These Terms, together with applicable purchase terms and policies expressly referenced here, form the agreement between you and SkyTile regarding the matters they cover. They do not override express product promises, written warranties, or mandatory legal rights.

If a provision is unenforceable, the remaining provisions will remain effective. Failure to enforce a provision on one occasion does not waive the right to enforce it later.

You may not assign your account or contractual obligations without our consent, except where applicable law permits otherwise. We may transfer these Terms in connection with a business transfer, provided doing so does not reduce your mandatory rights or existing contractual protections.

20. Changes to These Terms

We may update these Terms to reflect changes to the Services, our business, or legal requirements.

We will post updated Terms and revise the “Last updated” date. For material changes affecting existing users, we will provide reasonable advance notice where practicable, explain when the changes take effect, and obtain acceptance where required by law.

Changes will not retroactively alter an accepted order or an existing dispute without your agreement or a legal requirement.

If you do not accept updated Terms, you may stop using the affected Services and close your account. Any applicable cancellation, refund, or other statutory rights remain available.
